Assim decidiu a&nbsp;2&ordf; Turma do Tribunal Superior do Trabalho em a&ccedil;&atilde;o movida por uma operadora de produ&ccedil;&atilde;o de frigor&iacute;fico contra a Brasil Foods (BRF).<\/span><\/div>\n<div style=\"margin: 0px 0cm 16.2pt 35.4pt; padding: 0px; line-height: 1.22em; outline: none; zoom: 1; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;\">\n\t<span style=\"line-height: 1.22em; outline: none; font-size: 11pt; color: black;\">No processo, a funcion&aacute;ria, que solicitou a rescis&atilde;o indireta de contrato de trabalho, alegava que permanecia longos per&iacute;odos em c&acirc;maras frigor&iacute;ficas, exposta a temperaturas abaixo de 12 graus Celsius e a ru&iacute;dos acima dos n&iacute;veis toler&aacute;veis.<\/span><\/div>\n<div style=\"margin: 0px 0cm 16.2pt 35.4pt; padding: 0px; line-height: 1.22em; outline: none; zoom: 1; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;\">\n\t<span style=\"line-height: 1.22em; outline: none; font-size: 11pt; color: black;\">Segundo ela, o uso dos EPIs n&atilde;o eliminava totalmente as interfer&ecirc;ncias do ambiente. A trabalhadora disse ainda que, ap&oacute;s sair do local, era necess&aacute;rio um intervalo para que o corpo recuperasse a temperatura, mas a BRF n&atilde;o permitia.<\/span><\/div>\n<div style=\"margin: 0px 0cm 16.2pt 35.4pt; padding: 0px; line-height: 1.22em; outline: none; zoom: 1; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;\">\n\t<span style=\"line-height: 1.22em; outline: none; font-size: 11pt; color: black;\">O relator do recurso no TST, ministro Jos&eacute; Roberto Freire Pimenta, ressaltou que o direito aos intervalos citados est&aacute; previsto&nbsp;no artigo 253 da Consolida&ccedil;&atilde;o das Leis do Trabalho. A norma delimita que deve ser concedido um per&iacute;odo de 20 minutos de repouso a cada 1h40min de trabalho cont&iacute;nuo em c&acirc;maras frigor&iacute;ficas.<\/span><\/div>\n<div style=\"margin: 0px 0cm 16.2pt 35.4pt; padding: 0px; line-height: 1.22em; outline: none; zoom: 1; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;\">\n\t<span style=\"line-height: 1.22em; outline: none; font-size: 11pt; color: black;\">&quot;N&atilde;o h&aacute; d&uacute;vida de que o trabalho desempenhado em c&acirc;mara fria envolve dificuldade muito maior do que o realizado fora desse ambiente, da&iacute; a necessidade do gozo do intervalo para recupera&ccedil;&atilde;o t&eacute;rmica e da utiliza&ccedil;&atilde;o de equipamentos de prote&ccedil;&atilde;o individual&quot;, afirmou.&nbsp;&quot;Nesse contexto, o fornecimento e o uso adequado dos EPIs, sem a concess&atilde;o do intervalo, n&atilde;o afasta a insalubridade&quot;.&nbsp;<\/span><\/div>\n<div style=\"margin: 0px 0cm 16.2pt 35.4pt; padding: 0px; line-height: 1.22em; outline: none; zoom: 1; background-image: initial; background-attachment: initial; background-size: initial; background-origin: initial; background-clip: initial; background-position: initial; background-repeat: initial;\">\n\t<span style=\"line-height: 1.22em; outline: none; font-size: 11pt; color: black;\">Na a&ccedil;&atilde;o, a funcion&aacute;ria tamb&eacute;m pedia a rescis&atilde;o indireta do contrato de trabalho. Esse tipo de situa&ccedil;&atilde;o ocorre quando o empregador comete uma falta grave e permite ao empregado pedir demiss&atilde;o mantendo o direito de receber todas as verbas rescis&oacute;rias. O TST concedeu o pedido com base no descumprimento das obriga&ccedil;&otilde;es contratuais pela BRF.
